Governor Greg Abbott has instructed the Texas Department of Public Safety (DPS) to intensify enforcement against vape and smoke shops that do not comply with state laws regarding hemp products.
“Texas will protect children from dangerous hemp products,” Governor Abbott stated. “Today, I directed the Texas Department of Public Safety to increase surveillance and enforcement of any vape and smoke shop violating Texas law. Texas will prioritize protecting our children.”
Under this directive, DPS’ Criminal Investigations Division (CID) will focus on identifying shops that may be in violation, collaborating with state, local, and federal agencies to conduct inspections. CID Special Agents will use information from these inspections to carry out undercover operations aimed at uncovering illegal activities and starting further criminal investigations.
The DPS Crime Lab is set to test any seized products from these efforts. If violations are found, CID Special Agents will pursue charges against employees and shop owners who break Texas law. The DPS also plans to work closely with federal and local law enforcement partners throughout these investigations.
This move follows an executive order issued by Governor Abbott last month directing several state agencies—including the Texas Department of State Health Services, the Texas Alcoholic Beverage Commission, and DPS—to act immediately in protecting children from hemp-derived products while adhering to federal law and safeguarding adult liberties.
