The Broker-Lawyer Committee (BLC) convened on October 10 to welcome new members, review public feedback on recent proposals, and decide on the status of several form updates. The committee, which consists of six attorneys appointed by the State Bar of Texas, six members appointed by the Texas Real Estate Commission (TREC), and one public member selected by the Governor, introduced new appointees at this meeting: Kandi Luensmann as a broker member, Kristen Porter as an attorney member, and Kenneth Vall as an attorney member. Ron Walker was reappointed as Co-Chair and Broker Member.
The BLC recommended that TREC adopt three forms during its next meeting in November. These include temporary residential lease forms and a flood plain notice for use with leases. The forms were initially proposed at the August meeting.
Senate Bill 2349, effective September 1, 2025, exempts temporary residential leases and short-term leases from the requirement to provide landlords with flooding-related notices. In response to this legislative change, TREC has updated its Landlord’s Floodplain and Flood Notice along with two temporary residential lease agreements: Buyer’s Temporary Residential Lease and Seller’s Temporary Residential Lease.
After considering public comments and discussing further contract changes that may be necessary, the committee decided to ask TREC to withdraw other remaining proposals from consideration for now. These include potential updates to Paragraph 12, page 10 disclosure requirements, groundwater and surface water rights disclosures, conservation easement disclosures, windstorm disclosures, and other insurance-related disclosures. The committee plans to revisit these topics during its next scheduled meeting in January 2026.
